GDT (AUST) PTY LTD has now been officially struck off by the ASIC. Not that it really matters at this point.

Well, things could get quite interesting.

Charles just posted a letter from Mervyn to all BlueChippers. Interesting communication strategy.

The basic message of the letter is that he wants to know who is with him, and who is not. By that I mean, he wants each DXBC'r to e-mail him back and let him know if they want to join Brian Thompson in the Liquidation, and thereby lose all their money, or keep their investment with him, further developing the property, and 'keep' their investment money. Quite interesting really! I will not attempt to directly influence anyone to answer back to Mervyn one way or the other. I'll gladly answer questions though.

I'm going to take on one point from Mervyn's letter and demonstrates just a bit of Mervyn's ongoing deception - chronic lying is what it is.

"One issue that was not foreseen was our key programmer left at a critical time when we were completing part of our key development. It did cause a major problem, as most likely was the intention and this caused further obstacles and delays."

Now prior to this 'key programmer' Mervyn references, there was the prior (original key programmer) that left him. He was the last programmer to leave (all the others had left because Meryvn had bled them dry and also not paid them) and he left once, because Mervyn failed to pay him. Mervyn convinced him to come back finally, so the programmer drew up a contract to protect himself and make sure Mervyn paid him. He was back in Mervyn's employ for about two months, then Mervyn stopped paying him again. He left for good. Mervyn still owes him wages.

Then we get to this 'key programmer' Mervyn references in his letter. This programmer joined Mervyn in January 2008. He is Mervyn's only programmer. While there, this programmer notices that nothing is really complete. There is no new development going on. None of the services we DX'rs might recognize are adequate at all. This 'Key Programmer' left not too long after, because Mervyn wouldn't pay him his wages.

Now this certainly sounds like the programmer(s) left deliberately in order to cause Mervyn trouble and disrupt the system, right? And clearly the departure of this programmer was 'unforseen' !!!

I'm sure that the need to put food on the table in Vanuatu for their families had nothing to do with their choices.

Here's some perspective.

Mervyn is hiding some money and some assets in 'other companies'. When I filed the windup petition with the court, Mervyn's report to the VFSC stated he had NO assets, and Brian Thompson was the ONLY creditor. Somehow, in Mervyn's mind, he was able to segregate me from all the other BlueChippers and "keep their money safe", in Mervyn's words. Mind you, the DXBC Agreement wasn't changed, nor were any DXBC'rs consulted to see if they wanted their investment avenue to be changed. The Judge in the Windup case, refused Mervyn's 'defense of wrong company being wound up' and stated it was clear from the documentation that GDT Inc. was the guaranteeing entity.

Legally, a company in Liquidation or bankruptcy cannot show preferential treatment. The court makes sure of that. To ask the investors if they want to join in the Liquidation of the company they invested in, or keep their investment (in another company in which they did not invest) sounds totally silly, does it not?
It really makes no sense whatsoever.

And IF Mervyn did hide assets which fully backed the DXBC investments and now is offering to continue to back or honor people's investments at their request, doesn't it seem totally wrong that Meryvn has already ignored the "BlueChip LIquidation" request of every DXBC'r that has submitted such, but says he'll consider yours in the future if you stick with him?

By DEFINITION, every DXBC'r should be a creditor automatically. Mervyn just doesn't see it that way.

Now having said that, I cannot tell you the system in Vanuatu is going to follow the right logic or not. I may be able to tell you later which way they are going.

My personal opinion is this letter should have no legal weight or relevance. It might however have criminal relevence!

Basically, the auction of the GDT assets (furniture and computer equipment) began yesterday. The personnel in Vanuatu have not been able to update me yet. There have been some 'all nighters' pulled getting the auction ready. I do anticipate getting some stories relayed to me this week.

Mervyn's computer went offline last week and I'm waiting to hear if it was confiscated for the auction or not.

Mervyn has been working hard to hide as many of his assets (computer equipment and furniture) from the authorities. It appears the authorities have been more successful than not at finding those items, even the computer equipment he hid above the ceiling in his 'new' office. To be clear, there are no substantial assets that would get anything back for the investors, but to ensure his 'new venture(s)' are slowed down or stopped has to be considered a minor victory. Yes, Mervyn has still been soliciting funds from people and so he keeps on going.

Equipment and furniture are being auctioned off, and that process will continue until it is all settled. Some steps have been taken to protect all the former investors and former participants by re-formatting and cleaning all the drives, eliminating the personal information contained therein. I expect to have more to say about that later when I can confirm the rest of the recently obtained equipment. The proceeds of the auction are going toward the settlement of the VU Customs debt due from Mervyn, and the balance to the VFSC. I'm just hoping there will be enough to cover the legal expenses I and others put out. I have my doubts, but just maybe.

As far as actual justice, that can only come from the authorities there in Vanuatu, or from Australia and surrounding countries. Efforts there continue, and for obvious reasons, cannot be discussed in any detail until certain actions occur.

I used the term "former investors and former participants" because there is nothing left. Mervyn has stolen and spent it all.

Amazing as it is, Mervyn has been attempting to get a website up that would compete with e-Bay. He has used the 'OLD' DXSynergy software and databases to start with and modified from there. Looking at it, it is obvious it is a 'made over' (but not completely) front end to the same ol incapable system. Whatever capability you saw in the DXS system is the same capability he was recently flirting with. Really sad. He can't even see the gross inadequacy and lack of capability his system has, and he still claims companies will sign up and use it. We'll see how it goes. As I mentioned above, that equipment may have been confiscated, but it remains to be seen in the is 'cat and mouse' game.

In the last month, the VU Customs Dept, linked with the VFSC, successfully raided Mervyn's 'new office' across the street from the Sebel Hotel, formerly hyped and longed to be named the DX Grand. By confiscating ALL Mervyn's equipment and furniture (just prior to the first raid, Mervyn hid equipment in the attic/ceiling) and effectively put an end to Mervyn's latest fraudulent efforts. One of his efforts was a website I had been watching closely, aimed at competing with e-bay. Other efforts of Mervyn's included 'Event Hosting and Planning', attempting to bring and host entertainment events in Vanuatu. All the while, Mervyn was continueing to tell people all kinds of lies, getting some to invest with him on the assumption/understanding that the 'commercial systems and plans' were days and weeks from being launched. From January 2008 through March 2009, Mevyn continued his efforts and successfully obtained monies from people that were wholly deceived. With all of his external bank accounts closed (Australia, USA, etc.) Mervyn used his bank account in Vanuatu to receive the wired funds from through his contact(s). All of that was brought to an end after the latest raids of his office.

All the assets that have been located at this point are the computer equipment, Satellite Dish, furniture (bought for the hotel), etc.. Just a note to highlight the obvious, there are no Bluechip funds around or dxgold coins laying around anywhere. It's all gone.
There have been specific efforts to guard former DXr's private information from distribution by deep formatting drives. More info as it comes out.

Sunday evening, April 5th, Mervyn left Vanuatu and returned to Australia.

Any follow-up actions on the part of any authorities will be made known as we continue to go through time. The page has been turned, and the new chapter is being written as we speak. Due to sensitive matters yet, we will wait until actions are taken before publishing any further news. But if you hear from Mervyn, it would be wise to take notes, and contact someone that is working on the case.

I don't know if justice and judgement will be fully served in this lifetime, but I know it will come, fully, for all, at some time.
