If I'm not mistaken even PayPal does not have license in all states, but PayPal's activity is based on conventional payment systems, accessible to, therefore well suited to "authorities". PayPal will not be in trouble.
The US based digital currency exchanger is guaranteed a "non licensed money transmitter" accusations, it is only a matter of time.
