The TIEA, or Tax Information Exchange Agreement is the latest in a series of attempts by the OCED to make the exchange of tax information much easier between members and offshore tax havens. Please note most of these agreements are not yet ratified and many do not involve the automatic exchange of information like the EU Savings Directive. Currently, for a nations without a TIEA, a country must use the MLAT, Mutual Legal Assistance Treaty, where ones exist, to obtain information which is an extremely onerous and expensive process to gather information on citizens they believe are involved in tax fraud and tax evasion.

The TIEA's apply to any type of account, personal or business -- although it is much less hard for a country to figure out who the owner of a personal account is as it is in their name on all the transactions -- in this case they only need to obtain information to provide if it is the person the requesting country thinks it is.

Well, this one is now official....

Liechtenstein Parliament Ratifies TIEA With US

Approved unanimously by Liechtenstein’s Parliament, the country’s Tax Information Exchange Agreement (TIEA) with the US, signed in December 2008, is due to enter into force on January 1, 2010.

Liechtenstein’s new Law on Administrative Assistance in Tax Matters (US TIEA Act) is designed to incorporate the individual provisions contained in the agreement into the country’s existing law.

Under the terms of the agreement, an exchange of information will only be granted upon receipt of a justified request submitted by the US tax authorities, which may be determined by a Liechtenstein court.

Designed to provide swift and efficient international administrative assistance, the amendment to the country’s constitution demonstrates Liechtenstein’s commitment to fully cooperating with information exchange in tax matters.

Delighted with the Parliament’s recent decision, Liechtenstein’s Prime Minister Klaus Tschütscher emphasised that adoption of the tax agreement has shown that Liechtenstein is “able to follow words with deeds".

"Liechtenstein is proving itself to be a reliable treaty partner, not only vis-à-vis the United States, but also with a view to the further agreements we want to conclude for the purpose of implementing the OECD standards," the Prime Minister continued.

With entry into force of the agreement, the QI status of Liechtenstein banks will also be extended by a further six years.

It is anticipated that the law will be passed in September.

"Another one bits the dust", but there are plenty of holes like "Swiss cheese" in the current TIEA agreements.

Netherlands, Cayman Islands Agree To TIEA Text

Technical negotiating teams from the Cayman Islands and the Netherlands have finalised the terms of an agreement and protocol for the exchange of information with respect to tax matters.

The proposed Tax Information Exchange Agreement (TIEA) was drafted during two days of meetings in George Town on Wednesday and Thursday, June 24-25. The text has been initialled by both parties.

The draft agreement covers many of the standard provisions in the Organisation for Economic Cooperation and Development (OECD) model agreement for the exchange of information on tax matters. It will now be submitted for formal approval by the cabinet and parliament of both jurisdictions.

Attorney General, Samuel Bulgin, led the Cayman Islands’ delegation while Rob van Kuik, International Tax Counsellor for the Dutch Ministry of Finance, led his country's delegation.

At the conclusion of the discussions both delegations welcomed the efforts and commitment by the two jurisdictions to conclude a TIEA in a timely manner, noting that the agreement will provide an internationally recognised framework for the exchange of tax information.

Timms Announces UK Tax Treaty Priorities

UK Treasury minister, Stephen Timms, has announced details of the UK’s treaty negotiating priorities for the year to March 31, 2010.

Timms, Financial Secretary to the Treasury, disclosed in a July 1 announcement that the government intends to take forward work on new tax conventions with almost 20 onshore and offshore jurisdictions, including Australia, Austria, Belgium, the British Virgin Islands, the Cayman Islands, Croatia, Ethiopia, Germany, Hungary, Israel, Luxembourg, New Zealand, Oman, Qatar, Spain, Switzerland and Thailand.

The UK’s double taxation convention priorities are reviewed by the government each year to ensure that the treaty network continues to meet the needs of the businesses and individuals receiving income from abroad.

Several new double tax treaties signed by the UK have come into force recently, including agreements with: Saudi Arabia (signed October 31, 2007, in force January 1, 2009); Slovenia (signed November 13, 2007, in force September 11, 2008); and Moldova (signed November 8, 2007, in force October 30, 2008). In addition, new protocols signed with Switzerland and New Zealand on June 26, 2007 and November 7, 2007, respectively, came into force on December 22, 2008 and August 28, 2008, respectively.

In 2008 and 2009, double tax agreements were also signed with the Netherlands, France, Libya, Mexico, and the Cayman Islands.

The UK also plans to progress work on Tax and Information Exchange Agreements (TIEAs) with three offshore territories, including Anguilla, Gibraltar and the Turks & Caicos Islands.

The UK has as an ongoing programme of TIEA negotiations with jurisdictions that have committed to implement the Organization of Economic Cooperation and Development’s international tax standard of transparency and exchange of information for tax purposes.

A TIEA between the UK and Bermuda was signed in London on December 4, 2007, entered into force on November 10, 2008 and took effect from December 4, 2008.

A TIEA and an arrangement amending the 1955 Double Taxation Arrangement between the UK and the Isle of Man, signed in Douglas on September 29, 2008, entered into force on April 2, 2009. The provisions of the TIEA also took effect in the UK and the Isle of Man on April 2, 2009.

A tax information exchange agreement and an agreement for the avoidance of double taxation of individuals, between the governments of the UK and the British Virgin Islands were signed in London on October 29, 2008 and laid before the UK parliament on June 17, 2009 at the same time as TIEAs and treaty amendments with Guernsey and Jersey.

Bermuda set to sign its 13th TIEA with Germany

Bermuda was scheduled to sign its 13th tax information exchange agreement (TIEA) with Germany at the Germany Embassy in London today.

The bilateral agreement, which was due to be signed by Finance Minister Paula Cox and German Ambassador Georg Boomgaarden, will provide for a full exchange of information on criminal and civil tax matters between the two countries and concludes years of preparatory work and negotiations held in 2008.

Bermuda has also concluded negotiations on three further TIEAs.

"Today, Bermuda having signed 13 of its 16 concluded TIEA negotiations, has put clear water between Bermuda and those jurisdictions which only just made the international standard," she said.

"It sends a signal to the G20 and OECD that Bermuda, as a white listed jurisdiction, is committed to the OECD initiative and intends to exceed by the widest of margins the minimum standard of 12 TIEAs." The Island moved from the Organisation of Economic Co-operation and Development (OECD) 'grey list' to the 'white list' in early June after signing its 12th TIEA with the Netherlands, having already signed agreements with the US, the UK, Australia, New Zealand and the seven member Nordic Group, and concluded negotiations with Mexico and Canada.

Ms Cox said that Bermuda plans to conclude TIEAs with all of the G7 countries and other important international trading and commercial partners.

"With today's signing, we have taken a big step closer to our goal," she said. "We have underlined, yet again, our commitment to supporting the OECD initiative to implement standards of information exchange and transparency and we shall continue to work assiduously to strengthen worldwide tax co-operation."

Yes, however to find out if it is ratified you have to look up each individual agreement. Also it does not talk about the agreements that are to be signed which is very important. Once the agreement is signed it could be to late.

Switzerland Concludes TIEA With The UK

Switzerland and the United Kingdom have concluded negotiations on extending provisions within the existing double tax agreement between the two countries. The revised agreement will grant assistance in tax matters under Article 26 of the OECD Model Convention. The DTA was negotiated in accordance with the parameters decided by the Swiss Federal Council.

On March 13, 2009, the Swiss Federal Council decided that Switzerland would change policy on international cooperation in tax matters and adopt the OECD standard on administrative assistance in tax matters under Article 26 of the OECD Model Convention. The decision will permit an exchange of information on tax matters in individual cases where a specific and justified request has been made.

Following the Federal Council decision in March, the United Kingdom is the tenth country with which Switzerland has initiated a Double Tax Agreement containing the extended administrative assistance clause. Switzerland has already concluded agreements with Denmark, Luxembourg, Norway, France, Mexico, the USA, Japan, the Netherlands and Poland.

The Swiss cantons and business associations will now have the opportunity to submit their views on the convention. The Federal Council will then decide on the authorization for signing after which the agreement will be published.
