Liquidator says funds salted away to HK

THE GOOD news is that the total losses of Filipino investors in the foreign exchange trading scam of Performance Investments Products Corp. (PIPC) were significantly lower than initially estimated.
The bad news is that only a small fraction of this amount was deposited in the company's main bank account, with the rest likely having been salted away in Hong Kong, according to a court-appointed provisional liquidator.

In its first report to investors, financial forensic firm Ferrier Hodgson said that funds lodged by local investors with PIPC were deposited in Hong Kong bank accounts of the company's offshore unit.

"Information provided to us to date indicates that, at least from the Filipino investors, there was in excess of $138 million deposited in the various investment schemes operated by the PIPC Group," the report said. "It appears from the information provided to us by bankers allegedly holding these funds that only approximately $2 million remains in these accounts."

The figure is significantly lower than the $250 million initially thought to have been lost in the scam after the company's owner, Singaporean Michael Liew, disappeared last month.

Nonetheless, the amount--about P6.47 billion at the prevailing exchange rate--ranks as one of the biggest losses to a scam in the country, mainly due to the relative affluence of the company's clients.

Having so far failed to locate Liew, many local investors now want to sue PIPC's depository banks, like Dutch banking giant ABN Amro, for possible breach of their fiduciary responsibilities.

According to Ferrier Hodgson executive director Rod Sutton, however, the bulk of the funds were never lodged with the bank, contrary to claims made by PIPC to its clients.

"I am informed by management that they would anticipate in excess of $138 million being held in these accounts," he said in his report. "A review of the bank statements indicate that the highest balance held in the ABN Amro accounts in the last 12 months is less than $5 million."

While this unfolded, rifts began to develop within the local group of PIPC investors, with some opposing the role being played by Ferrier Hodgson because of potential conflicts of interest in the case.

In an online forum named "PIPC Pyramid Scam," several investors questioned the appointment of the Hong Kong-based firm as provisional liquidator by a Hong Kong court because it was initially hired by PIPC general manager Cristina Gonzales-Tuason.

Sutton has already denied that his firm was working to protect the interests of Tuason and other PIPC officials.

Tuason is, herself, the subject of a criminal complaint filed by PIPC investors with the National Bureau of Investigation.

A group of investors have now hired a fresh set of lawyers to argue their case before the Hong Kong courts independently from the efforts of Ferrier Hodgson, which is represented locally by lawyer Sigfrid Fortun.

Earlier in June, the commission blocked three such websites namely, www.swisscash.net , www.swisscash.biz and www.swissmutualfund.biz .

SC also reminded investors that Swiss Mutual Fund and SwissCash are not licensed by the commission and the activities of these schemes have been declared illegal by several countries such as Jamaica and China.

It said the public should not be taken in by assurances of the scam's operators and agents that the promised returns will be paid through short messaging service (SMS) or mail, or once the websites are unblocked.

"SC will continue to take all measures to combat investment scams including blocking access to more websites, and taking appropriate enforcement actions against it's operators and agents," it said.

On the Civil Suit filed by the SC against the persons behind SwissCash, the court is schedueled to hear on Sept 24 the inter parte Mareva injunction together with an application filed by the SC for orders directing one of the defendants, Amir Hassan to transfer his overseas monies back to Malaysia.

On June 21 this year, the SC obtained a worldwide Mareva injunction against persons involved in the SwissCash investment scam, preventing them from disposing their assets in and outside of Malaysia.

The Mareva requires the defendants to disclose information pertaining to all their assets in and outside of Malaysia, the companies they have incorporated and the bank accounts they operate.

The other Defendants in the Civil Suit are Albert Lee JKee Sien, Kelvin Choo Mun Hoe, Dynamic Revolution Sdn Bhn, Swiss Mutual Fund (1948) S.A, SMF International Ltd, SMF (1948) International Ltd.

What would it take you to finally realize that Swisscash is nothing but a scam ?

I mean Swiss Mutual Fund (1948) S.A. was dissolved in December 13th 2006 and that means that it is no longer legally a business entity.
