IMO, it all depends on how the government interacts with the "ponzi". Afterall, there are a few things that could be considered legal ponzi's. The only difference I can see is that the government benefits from the legal ones. I'm sure if the AS industry paid the government a nice little percent of any income generated, the governments would have a different view of them.

Now if the share price of a small company hidden from the world increases 100% in one day, majority of people including the authorities suspect foul play. Why, is there any rule in this world saying small company cannot grow 100% in short-time.

Although I didn't take the time to watch the video, the reporter was most likely paraphrasing the fact that most people should, "Don't be a dumbass and lose all of your money. Use your gut." This is why people get swindled on ebay everyday.
Some of the best advice people can follow is a little gut hunch sometimes.
